The author gives specific criticism for some measures in the twenty-five year old act, and talks briefly about some pending changes to the act, as proposed by legislators. The author claims that the government routinely gathers information about citizens from electronic sources, especially from the internet. And because the ECPA is older than the internet, it is not written to address violations of privacy that occur in that realm. Other things that have changed since the law was written include the explosion of the cell phone market, text messaging, social networks, and an overall proliferation of computer usage.
