The Supreme Court 2 The United States Supreme Court was established to preserve and interpret the Constitution of the nation. The U.S. Supreme Court is often referred to as “the court of last resort” and determines issues of constitutionality as well as federal statutes. “The Supreme Court plays a unique role in the pantheon of American appellate courts because of its authority and influence on many of the most significant legal, political, and social issues in the nation.” (The Courts in Our Criminal Justice System, 2003, p. 483-484). The United States Supreme Court is the ultimate deciding factor that creates precedents establishing the fundamental shape of laws in America. Although many argue that the legislative branch make the laws, the executive branch enforce the laws, and the judicial branch interprets the laws, the decisions made by the Supreme Court and other appellate courts set precedent that in some ways creates laws. For example when the United States Supreme Court finds a law unconstitutional the legislative and executive branches cannot present laws that contradict the ruling. Many legislative and executive determinations of presenting laws are based on how they believe the courts will interpret the laws. The purpose of the Supreme Court is to determine the constitutionality of laws, ensure due process was served in lower federal courts, and resolve conflicting interpretations of laws. The process of checks and balances is important to ensure the appropriate interpretations to law are followed and it is a vital aspect of the Supreme Court.
