Huan Long (201005051) Case 2 Brief: DAVIS, Plaintiff v. WHITE, Defendant Facts: On September 10, 1977, White shot Davis in the stomach with a handgun by accident when he intended to shot Tipton, the person White had argument with and just passed with twenty-five feet of Davis. White was arrested for the shooting and the court found him guilty of maiming Davis and sentenced him to serve five years in the state penitentiary. On February 26, 1980, Davis obtained a default judgment against White in the amount of $50,000.00 in the Circuit Court for the City of Richmond on the ground that White willfully and maliciously wounded Davis. White subsequently filed his petition in bankruptcy and Davis now asks this Court to declare White's debt on account of that judgment nondischargeable in bankruptcy.
