Brief of Case-Delchi Carrier v. Rotorex Facts of case: Plaintiff, the buyer, is an Italian corporation called Delchi Carrier, S.P.A. Defendant, the seller, is an American manufacturer of compressors. After seeing the sample defendant provided, plaintiff contracted to order compressors. Shortly after delivery, plaintiff received defective compressors that didn’t conform to the specifications. Defendant failed to cure the defects, and trying to mitigate the losses, plaintiff attempted to repair the compressors and expedited a shipment of previously ordered Sanyo compressors as well. Consequently, plaintiff also lost volume of sales by a closing of the assembly line for four days. Therefore, plaintiff brought suit for breach of contract and recovery of damages including consequential damages and incidental damages.
