Case brief 19: Harriscom Svenska, AB v. Harris Corp . 3 F.3d 576 Facts: The first dispute was between defendant Harris Corp. and plaintiff Harriscom. RF Systems, a division of defendant. On December 6, 1985, because a commodity jurisdiction proceeding by U.S. government, U.S. Customs detained a shipment of RF System’s products ordered by Harris Corp. After negotiation with government, plaintiff promised to withdraw from sales to Iran and government ruled that the model radio was not subject to export controls. But also because of this negotiation, plaintiff just could fill only 3/8 of order to Iran so Harriscom sustained lost profits. The second dispute was related to an agreement in 1984 that defendant promised to sell plaintiff entire inventory in Iran. But RF Systems couldn’t purchase any more model radios because of his compromise to U.S. government. Harriscom institute an appeal but his action was dismissed. However, several months later the trial court amended its judgment to revive Count C of the complaint and reserved for trial RF Systems’
