1. What are the usual recognized methods by which paralegals may be regulated? A. The usual method by which paralegals are regulated by having to obtain specific licensing, certification, and registration. Paralegals can face civil penalties for the unauthorized practice of law. In some states paralegals could face criminal penalties the unauthorized practice of law. 2. What is the American Bar Association? A. The ABA has been around since early 1900’s and is a voluntary organization that created model rules of professional responsibility to help with regulating lawyers. Most states use those models or have amended them. They have no disciplinary authority. 3. What is the American Bar Association’s Model Rules of Professional Conduct? A. The Model Codes of Professional Responsibility was amended and became the Model of Professional Rules of Conduct. Along with the new model rules a new ABA commission was created and named Kutak which is after the chair Robert Kutak. The model rules are referred to by most states as a reference or a guide. Most of states use a similar form of the ABA Rules of Professional Conduct. Each state has revised the
