SDCL 43-1-2: Classes of property. Property is either: (1) Real or immovable; or (2) Personal or movable. 3. How are real property and personal property distinguished in South Dakota? SDCL 43-1-3: Real and personal property distinguished. Real or immovable property consists of: (1) Land; (2) That which is affixed to land; (3) That which is incidental or appurtenant to land; (4) That which is immovable by law. Every kind of property that is not real is personal. 4. What law governs real property in South Dakota? SDCL 43-1-6: Real property within this state is governed by the law of this state, except where the title is in the United States. 5. What law governs personal property in South Dakota? SDCL 43-1-7: If there is no law to the contrary in the place where personal property is situated, it is deemed to follow the person of its owner and is governed by the law of his domicile. 6. What are the three methods that several persons may own property in South Dakota?
