Week 1 Contracts 2-3 1) Definitions a. Complainants - a person or entity who begins a lawsuit by filing a complaint, and is usually called the plaintiff, or in some cases the petitioner. b. Specific performance - grants the plaintiff what he actually bargained for in the contract rather than damages for not receiving it c. Instrument - a written legal document such as a contract, lease, deed, will or bond d. Answer – It is the defendant’s reply to the complaint, bringing up issues that the defendant will address in court e. Decree – The final judgments f. Assignment of error - A statement by the appellant of the errors alleged to have been committed in the lower court is an assignment of errors, a type of appellate Pleading used to point out to the appellate court the grounds for review. It controls the scope of an appeal because if a ground for review is not contained in it, it will not ordinarily be considered by the court. Lucy v. Zehmer (1954) – Lucy (Brother and sis) is the complainants. Zehmer is the defendant.
