We need laws to: 1. Protect society, the individual, their property/goods & rights eg right to vote, freedom from discrimination etc. 2. Provide social cohesion 3. Code of acceptable behaviour 4. Provide a mechanism for dispute resolution 5. Reflect society’s values & attitudes To be effective laws: 1. Must be known by the community 2. Easily understood (lacking in ambiguities) & able to be changed 3. Acceptable to our current values 4. Enforceable Changing values in society: 1. As our values & attitudes change, the law must remain acceptable to individuals in society must change to keep up with these changing values. 2. Eg. Statute Law Amendment (Relationships) Act 2001 – recognises same sex couples in areas of probate, health and ownership of property Changes in society: 1. Society is constantly changing & laws need to keep pace with this. 2. Shop Trading Reform Act 1996 (Vic.) – deregulates shop opening hour Advancements in Science: 3.
