Littman 1 Joe Littman History 112 Professor Jackson 10 December 2010 History Final Question 2 The 14 th Amendment has had a sweeping effect throughout American history, often serving as the basis for deciding court cases with huge impacts on this country. The 14 th Amendment was adopted to provide all citizens with equal protection under the law, which has recently been interpreted to define a corporation as an individual. This came about after Citizens United sued the Federal Election Commission because it was prevented from running a short film on Hillary Clinton. The decision of the Supreme Court repealed the Bipartisan Campaign Reform Act of 2002, which forbid corporations from running advertisements close to election campaigns. The 14 th Amendment has already had an impact on one election and has been projected by scholars, to have a significant impact on our society as this century continues. Our nation was founded on democratic form of government. President Obama responded to the Citizens United case, saying “that in a democracy, powerful interests must not be allowed to drown out the voices of ordinary citizens” (Seligman). Scholars have also reacted to the new freedom corporations have been given under the 14 th Amendment with hostility. Joel Seligman, a professor at the University of Rochester, said in a recent speech that the Supreme Court’s interpretation of the 14
