Explain how they apply and what impact they have in your business.Electrical safety - Relationship with Electrical Safety Act 2002 (1) This section applies if— (a) this Act, in the absence of this section, would have application in particular circumstances; and (b) the Electrical Safety Act 2002 also has application in the circumstances. (2) This Act does not have application in the circumstances to the extent that the Electrical Safety Act 2002 has application. Example for subsection (2)— Section 19(1) of this Act provides, among other matters, for circumstances in which a duty is imposed on a person who conducts a business or undertaking to ensure, so far as reasonably practicable, the health and safety of workers mentioned in the section while the workers are at
work in the business or undertaking. The Electrical Safety Act 2002, section 30(1), provides for circumstances (the electrical safety circumstances) in which a duty is imposed on that person to ensure the person’s business or undertaking is conducted in a way that is electrically safe. Accordingly, the duty under section 19(1) of this Act to the extent it is mentioned above, that apart from this section would apply to the electrical safety circumstances, does not include a duty to ensure the person’s business or undertaking is conducted in a way that is electrically safe.Section 38(1) of the Model Work Health and Safety Act:
