Autonomy (Will) Theory of Contract Autonomy has overriding value Fairness, welfare of individual chooser cannot void a voluntary contract Consent can therefore make any contractual terms valid Will Theory of Contract would support: Contracts into slavery Sale of any individual rights to others Quid pro quo sexual harrassment Is this doctrine disturbing or liberating?

Why Accept the Will Theory of Contract? 1. Subjective Theory of Value: the value of anything to a person = the value that person autonomously sets upon it Claim: we should respect the value individuals ascribe to things The individual's contractual choices reflect the value of things to her Problem: can't individuals be mistaken about their own interests, values? 2. Self-Ownership : people have property in themselves, own bodies. Right to property = right to sell, use, destroy it without asking permission of anyone else Denial of right to destroy self is denial of property rights Maximize individual liberty by making autonomy a property right
