ETHICAL AND LEGAL ISSUES IN PROCESS MODELING 1 Abstract The following paper is an analysis of case wherein the software developer was unable to meet the operating and quality criteria set out by the client company. The analysis explores the ethical and legal ramifications of the issue and how the software developer is liable within the allowances of the contract and outside the same. The paper helps understand typical issues encountered in such situations and how these can be resolved within the legal and ethical frameworks.

ETHICAL AND LEGAL ISSUES IN PROCESS MODELING 2 Introduction It is known that only 30% of software projects succeed in creating the business value that they were intended. Most projects fail because the software solution developed is unable to meet the business requirements including the desired quality expectations of the users. This outlines the importance of having a robust quality management plan for software projects. Quality management plans should include standard quality related interventions through the project life cycle and also best practices that are based on the learning from other similar projects of similar scope, size, technology and business functionality. It is the software developer’s responsibility to provide high quality and stable software that meets the users requirements as had been agreed in the scope of the project. Quality related issues that occur in software projects can be looked at from various perspectives – ethical, legal, knowledge, project management and cultural. In this paper we look at the issue of quality management using the ethical and legal perspective. Legal perspective of software projects are covered under contract that is executed between the sponsor of the project and the developer of the software solution. The ethical requirements of the project are usually implicit between the software developer and the sponsor. These can also be recorded in the business case and the project charter (Georgakellos et al., 2009).
