ARE 18 February 9, 2011 Homework 5 9-5. In the case involves a professional boxer, Barrera, and a man that was unlicensed but representing him, Castillo. Castillo was not licensed by the state but had orally agreed to be Barrera's manager. Castillo negotiated an exclusive promotion contract for Barrera with Golden Boy Promotions, helped him settle three lawsuits and resolve unrelated tax problems so that Barrera could continue boxing. However, Castillo did not train Barrera, pick his opponents, or arrange any of his fights. So Barrera stopped communicating with Castillo which resulted in Castillo filing suit in a California State court against Barrera and others claiming a breach of contract. However, as stated in the first sentence of this problem, "under California law, a contract to manage a professional boxer must be in writing, and the manager must be licensed by the state athletic commission." Castillo did not meet this standard when he agreed to take on Barrera and pursued being his manager any way. Even though he
