Budget your time accordingly. Answer a l l t h e questions reasonably r a i s e d i n each problem even though your r e s o l u t i o n of a p r i o r i s s u e i n the same problem may t e c h n i c a l l y make decision of o t h e r i s s u e s immaterial. I f you b e l i e v e t h a t you need more f a c t s than a r e presented t o adequately resolve an i s s u e , i n d i c a t e s p e c i f i c a l l y what f a c t s you b e l i e v e you need and why. I ( 7 5 minutes) Consider t h e following s e t of f a c t s : "The apartment i n question is seven s t e p s below ground l e v e l , and has a p r i v a t e entrance n o t i n common with other residences i n the building. The defendant [ , Fred Shorty,] stayed i n t h e apartment from time t o time. The defendant claimed t h a t he was renting t h e apartment, although t h e u t i l i t y b i l l s came t o one of t h e defendant's g i r l f r i e n d s , and t h e defendant did not have a key t o t h e apartment a t t h e time of h i s a r r e s t . Three informants . . . reported t o t h e p o l i c e t h a t t h e CRIMINAL PROCEDURE 5 B -2- EXAM NO. defendant was s e l l i n g cocaine from t h e apartment. The informants described t h e defendant a s a black male, i n h i s l a t e t h i r t i e s , and 5'10" i n height. The p o l i c e were also t o l d t h a t t h e defendant drove an orange Volkswagen Beetle, which t h e police had seen i n t h e a r e a . "The informants described a simple procedure t h e defendant used t o advise h i s p o t e n t i a l customers t h a t he had cocaine t o sell. Day o r n i g h t , i f t h e porch l i g h t was on, the defendant had cocaine for s a l e . I f the porch l i g h t was o f f , t h e defendant d i d not have cocaine f o r s a l e . Sporadic s u r v e i l l a n c e of t h e apartment confirmed the informants' r e p o r t s . When t h e porch l i g h t was on, even during t h e daytime, t h e police o f f i c e r s observed many v i s i t o r s t o the apartment.
