Applying PL to Current  Controversies 1 st  Controversy—Plural Marriage PL WOULD allow plural marriage To disallow it (because we don’t think that is a good kind of  marriage) would be to favor some religions or conceptions of the  good and not others PL WOULD NOT allow plural marriage Practical difficulties: complications of legal rights tied to marriage  being applied to groups of 3+ ppl. no appeal to controversial moral/religious views here Overlapping consensus  against  plural marriage exists  those who favor plural marriage are so small in number, that  they do not have to be considered  Rawls says an OC involves all doctrines with a *sizeable*   number of adherents 3

Is the U.S. Politically Liberal? Think about how politicians, voters,  political organizations, etc. approach  constitutional and social issues Do they appeal to religion to support their  views? Do they suggest creating laws based on their  personal controversial moral beliefs? 4

In Favor of PL PL gives us hope as to how reasonable people  of radically different views can live together  on terms justifiable to all What do we end up with in a pluralistic  democratic society if we don’t follow PL? Culture wars over controversial social issues? Bickering over whose religion is the right one? Inability to justify our govt. to all?

In Favor of PL, cont. PL offers a kind of  politeness-respect for  moral and religious differences “Never discuss religion in polite company.” Discussions of moral/religious views often get nasty.   Better not to go there at all.  Let’s keep our moral and  religious views to ourselves.
