Argues that certain reasons against the death penalty are wrong but does not present much of a positive argument for it Look at one or two of his reasons (don’t mention all six) Nathanson- against Eye for an eye Two sections: First section: there are problems with strict retributivism (either a criminal should get the exact punishment that they did or the punishment should be equal). He rejects this because he says that it is impossible. No crime can ever have the same punishment because every crime and every person is different (someone might want the death penalty, someone might not) Another kind of retributivism: proportional- harsher crimes deserve strong punishments. Weaker crimes deserve weaker punishments ^Does not offer support for death penalty Does not tell us what the harshest punishment should be
