It is critical for paralegals to be not only aware of, but intimately familiar with, the ethical rules that regulate attorneys. While paralegals are not directly regulated by those rules, they are indirectly regulated by them and must adhere to them. Sometimes the line between not practicing law and the unauthorized practice law can be blurred so a good understanding of what is and is not UPL will help us make the right choices. Don't forget to post at least 5 times and on at least 3 different days over the course of the week. We're on the home stretch! REMEMBER -due to Winter Break from 12/21/11 to 1/2/12, you do not need to participate in the discussion board during that time. This week's discussion will run to the end of Unit 8 as a result. My background is in real estate brokerage and real estate education. In real estate brokerage, the line between real estate brokerage and the unauthorized practice of law can be blurred. That is why it is important for the broker to understand when a client or customer should be advised to seek legal counsel. Simply answering someone’s question could constitute the UPL. For example, a buyer breaches a contract and the seller asks the broker what recourses are available. The broker must exercise care in answering that question so as not to accidently engaging in the UPL.
