Case 08 Case 8-1 (Chapter 8, p. 242) NORTHEAST FENCE & IRON WORKS, INC. v. MURPHY QUIGLEY CO., INC. 933 A.2d 664 (Pa. Super. 2007) FACTS: Murphy-Quigley Co. is a general contractor responsible for fencing and security upgrades at the Bucks County Correctional Facility. Murphy-Quigley contracted with Eagle Fence to do the fencing. After completing only a portion (15%) of the fencing, Eagle Fence quit. In an emergency situation, Murphy-Quigley contracted with Northeast Fence & Iron Works to complete the fencing. These parties did not take time to negotiate and document a clear understanding of the work to be done and the costs of it. When the work is done, Northeast Fence & Iron Works submitted an invoice in the amount of $134,428.30. Despite accepting the fencing done by Northeast Fence & Iron Works, Murphy-Quigley objected to this total. Northeast Fence & Iron Work sued, the trial judge ordered Murphy-Quigley to pay $114,246.06 on the basis of quasi-contract to avoid Murphy- Quigley being unjustly enriched at the expense of Northeast Fence &
