Case 11 Case 11-1 (Chapter 11, p. 322) INCASE v. TIMEX 488 F.3d 46 (1 st Cir., 2007) FACTS: Incase makes us is discussed with the case at some length about providing packaging or Timex watches, but ultimately Timex went with a Philippine manufacturer of packaging. Later, in case noted that Timex has incorporated some of the Incase package designs and stood for trade secret violation. Issue: Did Timex violate the Incase trade secrets regarding package designs? DECISION: No REASONS: Merely showing the designs only to Timex was not adequate steps of secrecy to warrant trade secret protection. Protecting trade secrets calls for constant warnings of all those who know the secrets and further steps, preferably in writing, that promise nondisclosure of the secrets. Case 11-1
