Cases 36-CA-8743-1, 36-CA-8849-1, 36-CA-8789-1 and 36-CA-8842-1 (2007) FACTS: Employees were using their employer's e-mail system related to union activity. ISSUE: Whether employees' use of their employer's e-mail system is protected for Section 7 purposes and whether the employer's policy prohibiting employee use of the system for "non-job-related solicitations" violated Section 8(a)(1). DECISION: The employer may prohibit a union or employees seeking to solicit or organize for a union, from using company e-mail systems to communicate. REASONS: The employees have no statutory right to use their employer's e-mail system for Section 7 purposes. Case 21-1
