H ADM 3387 – Business and Hospitality Law Fall 2009 Lecture #21: 12-3-09 Intro: o Review session – Sunday – 1pm and 7pm – go through all material o o Exam formats – Contracts = 2/3 Unions = 1/3 (IRAC and short answer) Unions Cont. o EFCA – Employee Free Choice Act Seemed like a no-brainer when Obama was elected but now so much other stuff is going on Likely that Labor Law will be reformed (because unions supported Obama a lot) --- probably be ambiguous and left to Labor Relations Board to make policies 1. Card check will probably not pass 2. Congress will probably put in something to speed up elections and Board will issue a rule with a specific time period 3. Probably no definitive language Question: Do we really need Labor Law reform? Union membership significantly reduced so unions say YES Why = depends on what you believe 1. Economic argument = when unions were strong, there was a middle/working class because unions raised wages 2. Counter = we really can’t do that because what’s necessary now to be in US middle class takes much more money than in other countries --- we’d price ourselves out of the international market and send every industry into the ground (ex – textile workers that
