H ADM 3387 – Business and Hospitality Law Fall 2009 Lecture #18: 11-18-09 Intro: - Wed after class ends 4:15 Dec 2nd party at Rouloffs - Final: two dates Friday of first exam week + Thursday of 2nd exam week and Make-up = Tuesday of study week Cases: 1) Hyatt: - Facts: National Postmaster reserved rooms at Hyatt. Had to change date and cancelled. Hotel tried to charge them, they appealed. - Issue: Does Hyatt get paid under liquidated damages. - Law: Yes. If there is a liquidated damages provision in contract. You get damages. Not an act of God and not contemplated in the contract so you have to pay. Recent case. - *Contract interetation -- what did the contract allow for in getting out of it. 2) Concord: - Facts: Freeman an ad about a performance, then sees another ad that disputes it. Leaves after 2 days and asked for . Referred to section 206 on his room door. Sued under 206 for 3 times - Issue: Is advertisement a contract? Is your inferrence a contract? 206? - Law: No. Other ads were clear. 206 history. Statute 206 was a different time with a different purpose so it doesn't apply in this case. Unions:
