H ADM 3387 – Business and Hospitality Law Fall 2009 Lecture #17: 11-16-09 Intro: o Sign up is on Prof’s door for paper meeting o Final exams – Makeup Tuesday of study week, Friday of 1 st week, Thursday of 2 nd week (only 3 hours long) Cases: o Wooly: Facts: Hired by Hoffman, read personnel manual, then asked to resign about piping problems and conflicts w/his boss. Refused then fired. Issue: Breach of contract? Is your employee handbook a contract? Maybe. Can be a contract if done incorrectly. Not if written correctly. Law: Employment At Will. – 70s and 80s came under attack. People found ways to circumvent at will standards – went after employee handbooks. Because they seemed to give people contractual rights – supposed to be a philosophy not a contract. Michigan then other states found that it was a contract. Jersey – pro- employee state. Employers using it as a substitute for a Union bargaining agreement to keep unions out. Employer gives up at will = Employee gives up time – working. Employee handbooks can be contracts (LAW). Depends on state
