H ADM 3387 – Business and Hospitality Law Fall 2009 Lecture #7: 9-21-09 Intro Notes: o Sign up for exam o Monday 9/28 review session ADA o July 1992 ADA went into effect Applied to companies with 25+ employees, but in 1994 changed to include companies with 15+ employees People with handicaps covered by state statutes Government contractors added in the 1973 Act: Example) Blueberry grower in Maine sells to General Mills who sell to the US Military SO the blueberry grower is covered b/c it has a government contract “Emancipation Act for people with disabillites” Downsides: o More ‘Unfair discharge’ cases than ‘failure to hire’ cases o Most common disabilities (the cynical part of the act): 1) Bad backs 2) Mental disabilities 3) Alcohol and Drugs o Argue: A) Look how often ADA plaintiffs loose B) Compare to other protected classes ADA loose more often o Similar to a Position Statement, ADA has HURDLES that other Protected Classes don’t Is the person disabled?? It’s not always clear
