Patricia Yeager Moscow District Court Judge Stegner February 28, 2011 Purpose of the Proceedings : On December 27, 2010 the defendant Patricia Yeager was visited by her parole officer at 2:15 PM to simply check on her parolee. Upon arrival Ms. Yeager was simply not cooperative and had an escalated demeanor. The parole officer thought in her best interest and safety to handcuff Ms. Yeager. Ms. Yeager resisted arrest and upon searching her person, Ms. Yeager turned to her side and began kicking violently. Ms. Yeager kicked the parole officer who the court simply called Jackie. Issue: Is the defendant, Patricia Yeager, guilty of simple battery? Holding: Yes, guilty plea by the defendant Reasoning: The charge on the defendant was reduced from a felony to a misdemeanor upon a guilty plea by the defendant. The maximum sentence was also reduced to a fine up to $1,000 and/or up to 6 months in prison. The judge asked each party their argument
