against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.” (Case Law 2011) Part of the sixth amendment states, “and to have the Assistance of Counsel for his defense”. While this statement does not state that an indigent person is legally entitled to receive a defense attorney at no cost to him, the courts have defined this absolute right to counsel at trial over the years. In Powell v. Alabama eight black youths were sentenced to death in a trail that was hurried along without the help of counsel. “Justice Sutherland said for the Court, always requires the observance of certain fundamental personal rights associated with a hearing, and ''the right to the aid of counsel is of this fundamental character.'' (Case Law 2011) The statement was about the right to recall counsel in which they choose at their expense. Everyone has the right to be heard by counsel. Someone who may know much about their defense may not use the counsel that is provided and may be charged with improper charges, and may face the possibility of being convicted weather or not they are guilty or not.
