BLS NOTES 9/16/08 Chapter 2 Dispute Settlement Page 27- Plastix vs. Trendco State of NY Filing a complaint  State Court- Municipal court Alternative Dispute Resolution (ADR) Negotiate - have Trendco send back damaged boxes - Send back refurbished Negotiate so you don’t damage business relationships Mediation - The parties to the dispute choose a third party to assist them in settling it. -Parties can better work within jointly reached solution Arbitration - used to settle disputes in court Different from mediation because third party to whom the dispute is submitted decides  the outcome  -Arbitrator often has expertise in area of dispute 1. Submission of arbitration agreement 2. Arbitration clause - Minitrial-  (Executives of disputing companies)- Companies are more likely to settle Med/Arb - a combination of mediation and arbitration where the third party first serves  as a mediator, the as an arbitrator)
