03:39 Principle of legality: Legal duty to prosecute every case where there is suspicion   Principle of opportunity: No legal duty to prosecute every case where there is suspicion Prosecutor has discretion of whether or not he wants to charge a crime in America  Elements: Hall’s Seven Principles of Criminal Law continue…  Mens Rea: 1. State of mind, blameworthiness, “Guilty Mind” that accompanies a criminal act  need purpose and intention to establish  2. It is complex Varies by crime Includes recklessness or negligence  Motive : reason why one commits a crime  Need to have intent with regard to a specific action for it to be a crime  Motive isn’t necessary to have intent  Mens rea:  One wants to cause harm   intent to kill  Motive: Can get an outcome from committing the crime (killing someone  in order to  get money) 3. Four Levels: 1. Purposeful: higher level (more blame)
