Introduction Rita (‘Principal’) used materials to make art pieces to sale. Her neighbor, Barbie (‘agent’) was aware of the kind of materials Rita used. Barbie saw some materials and wanted to purchase them for Rita, so she informed the seller (‘Third Party’) that she was buying for Rita. The seller agreed to sell her the materials, and the seller expected to receive cash payment of $100 within a week. Barbie informed Rita about her purchase and Rita agreed to accept and pay $100 for the materials. The issue is whether the seller can claim that $100 from Rita. Principles used An agent is a person who, through the authority conferred upon him by his principal, is empowered to establish legal relations on his principal’s behalf with a third party. Typically, the contract binds the principal and the third party, and the agent is not liable to his principle and third party as long as he acts within the scope of authority given to him by his principal.
