Political Science Notes October 29, 2008 2000 Election Very close Election very close Originally called Florida for Gore Gore 268 electoral votes Florida law says there must be a recount if its within ½ % Recounts are done by county 6 million people voted in Florida – margin of less than 1,000 votes; but George W. Bush had still won, but Gore campaign demanded a manual recount Late recounts didn't count – Gore tried to take it to court, asked for recounts in 4 specific counties Bush went to federal court and said the recounts were illegal, then went to the US supreme to say the recounts were unconstitutional because 1. article 2 of constitution said that electors would be appointed by the state legislature but didnt mention the judial branch thus they dont have the authority to call for a recount. 2. even if they have the authority to call for a recount, it violates the equal protect clause but each county was setting its own standards Supreme court does not get involved in political cases. but they did in this case -- they decided that the Florida judicial branch had the authority to demand a recount -- by a vote of 7 to 2, the recount did violate the equal protection clause thus the recount is unconstitutional-- this ruling applied only this election in Florida Jeb Bush – Florida governor There was an unofficial recount to see what would have happened had they been allowed to have the recount – 2 kinds of questionable votes
