Introduction to Legal Studies Review Sheet JUST KNOW FOR THE MIDTERM substantive law- statutory or written law that defines rights and duties , such as crimes and punishments in civil law procedural law- rules in which a court hears and determines what happens in a civil lawsuit, criminal or administrative proceedings cause of action- set of facts sufficient to justify a right to sue to obtain money, property, or the enforcement of a right against another party inferior courts- court of limited jurisdiction trial courts- aka court of first instance, is a court in which trials take place and have original jurisdiction appellate courts- court with the power to review and reverse the decisions of lower courts sources of American law- common law, statutory law, administrative law, court rules, constitutional law stare decisis (precedent)- subject matter jurisdiction- of a state, county comes from the state or the constitution or a statute. Can be laid out in the state constitution diversity of citizenship
