Unformatted text preview: STEVEN HOWE ARBITRATION (1992) O 1986 Commissioner Peter Ueberroth wrote policy memorandum placing drug testing under auspices of Commissioner’s Office (Baseball’s Drug Policy and Prevention Program) O Left-handed pitcher Steven Howe hospitalized for drug-related treatment on 6 times and suspended 6 times between 1982-1988 (Commissioner Vincent) STEVEN HOWE ARBITRATION O Following suspension, Commissioner laid down plan for Howe: regular drug testing and removal from baseball with another positive test O Commissioner never formally approved or implemented testing program, so tests were irregular O After arrest for attempted possession of cocaine in 1991, Vincent imposed lifetime ban O MLBPA challenged ban in arbitration STEVEN HOWE ARBITRATION O “The Commissioner … can bar the employment of a player at any level of the game regardless of the opinion or wishes of any one of a great number of potential employers. That is an awesome power.
