1. (10 points) What changes are occurring in the workforce relative to the kinds of work employees are performing? Modern technology has changed the workforce and the work employees are performing. The workforce has moved more toward technology to accomplish most of its manufacturing which has led to a decline in the labor force. Today less than 20 percent of the workforce is involved in manufacturing and over 70 percent in service jobs. 2. (10 points) Discuss what is meant by the term exempt employee and the various exemption criteria established for identifying this group of workers. The term exempt employee refers to those employees who are exempt from certain requirements of the fair labor and standard act of 1938. Exempt employees are bona fide executive, administrative, professional, and sales personnel that meet certain requirements regarding job duties and responsibilities and are compensated on a salary basis. Employees who are paid at least $100,000 annually and perform office or non-manual work will be considered exempt if they regularly perform an identifiable executive, administrative, or professional job duty or responsibility as described by the new standard duty tests. For an executive exemption, employee must have a primary duty of managing the enterprise, department, or subdivision and direct the work of 2 or more employees and must have hire/fire authority. For an administrative exemption, the employee must have a primary duty of performing office work directly related to management or general business operations of the employer and exercise independent judgment. For learned professional exemption, the employee must have primary duty of performing work that requires advance knowledge which must be in the field of science or learning that is customarily acquired by a prolonged course of specialized intellectual instruction.
