Know the hierarchy of laws (i.e., federal law trumps state law) 3. Interpreting Legislation: Know the rules concerning statutory interpretation, rules of construction 4. Stare Decisis and Res Judicata: Know the meaning and effect of each. 5. Conflicts of Law: Know rules with regards to torts and contracts. 2 REVIEW KEY POINTS – CHAPTER 1 1. Court System: Know the courts of the federal and state court system; Distinguish between trial courts and appellate courts; know the function of the jury and the rules with regards to juries. 2. Jurisdiction: Know the distinction between courts of limited jurisdiction and courts of general jurisdiction. 3. Federal District Courts: Know these rules well!
