Explain the Supreme Court’s development of the constitutional right to privacy over the past-half century. In your view, has the court done a good job in thus policy area? Early 1900s, the Supreme Court created a doctrine known as substantive due process to guide its interpretation of some government policies challenged as violations of the guarantees contained in the due process clauses. Under the doctrine of substantive due process, the Court stressed the word liberty to prevent governments from enacting certain kinds of laws. Liberty was stressed to protect more than just contracts, but rights of the individual, including the right to be left alone, the right to knowledge, individual right to contract, right to marry, establish a home and bring up children. Fundamental liberties have been accepted to mean that they cannot face government intrusion unless weathering strict scrutiny.
