Lecture 2 15:24 Actor: people in the criminal justice system (lawyers, judge, police, etc.) Factual Guilt “vs.” Legal Guilt Factual Guilt:  Whether a defendant has committed a crime Legal Guilt:  Whether guilt has been established through procedure/trial Casey Anthony example  not legally guilty and we don’t know if factually guilty Context of Criminal Justice DUI, negligent physical injury Damages Insurance company increases premium  person who is injured can file a civil suit: tort Hans: Potholes! City has to compensate! Civil Law:  Conflict between two private entities (2 human beings or 2 companies) and  it’s usually about money A form of private law because it governs the relationships between individuals in society   ex: contract law, company law, tort Criminal Law:  Conflict between an individual and the state A form of public law designed to prevent or enforce certain types of behavior and punish  offenders
