Ex: peter accidentally kills Gretchen when he thought it was hans but it turns out it  wasn’t hans. Can’t use mistake of fact defense because murder is killing a person and  he didn’t mistake that it was a person, he just mistook who it was -cannibalism would be necessity defense  necessary to survive under natural  forces(avalanche, cold winter, snow) have to balance the harm you cause to a protected value and what you want to protect  (want to protect your life but taking a life at the same time)  necessity defense doesn’t  work when they’re equal cannot quantify the value of life -damage of property and disorderly conduct  -everything in your pockets, illegal or not, is private and can’t be searched without a  warrant. One exception is officer searching after a lawful arrest Police Functions Two possible natures of police actions 1.  Preventive Guarding against damages to public safety or order 2.  Retroactive Prosecution of crimes According to the text 1.  Order Maintenance (Watchman)  preventive a. Broad mandate to prevent behavior that disturbs or threatens the peace b. Disorderly conduct c. Officers have high degree of discretion
