The basic structure is a federal form. 2) What is the national government’s relation to the states? The national government and state government share sovereign power. Some powers can be excercised by the states other the federal government, and some by both. 3) What is the police power? State powers based on their sovereignty. Can be used to protect public order, health, safety, and general well fare. i) What is the conflict between the states’ police power and the commerce clause? The federal government has the right to regulate commerce between the states and within the states if it has an effect on the other states. 4) What is preemption? When federal law take precedence over state laws. 5) What is a constitutional limit on the power of Congress to tax? Congress may not tax some state while exempting others. i)
