Facts : Rio Properties, Inc. owns the Las Vegas hotel, RIO All Suite Casino Resort, as well as other gaming enterprises. Rio Properties actively sought to protect its rights to the “RIO” name though various trademarks with the Unites States Patent and Trademark Office, to maintain its strategic position in the gaming industry. In order to target a broader audience, Rio also marketed itself through the domain name www.playrio.com. Rio International Interlink, a Costa Rican business, conducted an online sports wagering operation. RIO became aware of RII through a radio advertisement campaign RII conducted in Las Vegas for its sports wagering website www.riosports.com. RIO issued an epistle calling for RII to cease and desist its operation of the www.riosports.com website. RII quickly closed the disputed website; however, it started
