Bill of Rights is collection of first 10 amendments to Constitution passed during first Congress, then quickly ratified by states. E.g., freedom of speech, religion, gun rights. .. Some differences between civil rights and liberties Civil rights: Needed a majority to take up the cause to secure civil rights (e.g., 1964 Civil Rights Act) Civil liberties: Check majority rule to protect minority

Civil Liberties Incorporation via the 14th Amendment B of R initially only protections from federal gov’t. Example: Barron v. Baltimore ruled B of R only applies to federal actions and not state actions. Incorporation through the 14th Amendment: Application of Constitutional rights to state actions Unified national citizenship, rather than separate federal and state. Civil rights and liberties are given to all people, regardless of state Selective incorporation began slowly in early 20th century — applying parts of B or R to state laws, i.e., nationalization of civil liberties Much like civil rights, national standard being applied to all states during 20th century
