Government Review 19-21 Engle v Vitale – dealt with prayer schools, declared mandated prayers in public schools unconstitutional, set precedent, reinforced separation of church and state. Gitlow v NY – Gitlow published “left wing manifesto” and was arrested and punished by NY, Gitlow claimed his rights to freedom of speech and press were violated, Court ruled that these freedoms did not apply when advocating a violent overthrow of the gov. Schenck v US – Schenck was arrested for distributing leaflets against the draft in WW1, led to development of “clear and present danger” Gideon v Wainwright – FL man convicted of a felony was not provided with his right to counsel during trial, trial violated his 6 th amendment rights and thus was unfair and unconstitutional. Mapp v Ohio – Illegal search and seizure, ruled that search warrant is required and any evidence obtained by other means is in violation of the 4 th amendment and is inadmissible in court Van Orden v Perry – issue over the presence of the ten commandments on the property of
