Strategic Human Resources Management Chapter Questions 1. Explain in your own words the complexities, limitations, and challenges associated with HR and the legal environment. The complexities associated with Human Resources and the legal environment are being able to understand as a firm and HR manager all of the intricate details in which a law pertains too and being able to apply these to the company. The limitations associated with Human Resources and the legal environment are that HR managers can not create miracles and completely whip away an error created by the manager but their job is to minimize or limit the damage. There are a lot of challenges that these firms face regarding Human Resources and the legal environment like fully understanding what these rules and regulations actually mean and how they are going to deal with consequences when they didn’t think they were doing anything wrong but just didn’t know fully comprehend certain parts of the laws. 2. Briefly describe the following legislation: Equal Pay Act of 1963 - this is a law that requires the same pay for men and women who do the same job in the same organization. Civil Rights Act of 1964 - this is a law that mandates employment decisions not be based on race, color, religion, sex, or national origin. Civil Rights Act of 1991 - this is a law has prohibited a very useful mechanism for reducing discrimination in employment decisions. There are three parts to this act burden of proof, quotas, damages and jury trials . Burden of proof is the idea that an employer has to prove himself or herself after an employee files a discrimination case. Quotas are employer adjustments of hiring decisions to ensure that a certain number of people from a certain protected class are hired. Damages and jury trail successful plaintiffs collecting punitive and/ or compensatory which are fines awarded to the plaintiff to punish the
