S.W.2d 862, 1982Facts:Elvis Presley got engaged to Alden’s daughter. Elvis made a promise that if Aldendivorced her husband he would pay for the divorce, purchase the husband’s equity in the homeand to pay off the remaining debt on the home. Alden proceeded with the divorce because of thispromise. However, before Presley could pay off the debt on the home, he passed away. He wasable to fulfill all other promises, except for this one. The Estate for Presley refused to pay theremaining debt, so Alden settled with her husband. She took responsibility for the house andmortgage, however, withdrew this because she believed they never entered into a bindingagreement. She decided to litigate. Trial courts ruled that Elvis Presley’s promise was merely agift and would not hold up. However, the decision was appealed by the court of appeals based onthe ruling of promissory estoppel.Issue:Is Presley’s promise to pay Alden’s mortgage enforceable based on promissory estoppel.Holding:The State Supreme Court reversed the ruling of the small courts, stating that promissoryestoppel was enforceable in this contract.Rule:The State Supreme Court ruled in favor of Alden based on Promissory estoppel.Promissory Estoppel prevents a promise from being withdrawn, because the decision wouldaffect the person who was promised.
