However, arguing from such a perspective illustrates a completemisunderstanding of the actual meaning of the phrase. It merely means that only the guilty partyshould be punished and the punishment should neither be too severenor lenient. Capitalpunishment is usually justified with the assumption that by killing a convicted felon, the legalsystem is actually deterring other criminals from engaging in crime. Supporters of capitalpunishment claim that for justice to prevail an offender should be punished in a manner thatbefits the crime. Therefore, in murder cases the only punishment that befits such as a heinouscrime is the death penalty.Deterrence is only effective when the punishment occurs immediatelyafter the crime, for instance in a hypothetical situation where a child likes playing with fire, oncehe or she is burnt they will learn not to place their hands near a fire since the repercussion is
