No. L-31934 July 29, 1977RAMON LANZAR, petitionervs.DIRECTOR OF LANDS and CITY OF ILOILO,Respondents.FACTS:In May 1960, Ramon Lanzar filed an application for registration a parcel of land allegingthat he is the owner in fee simple of such land.The Director of Lands and the City ofIloilo filed an opposition to the application on the ground that the land in question is aforeshore land which forms part of the public domain and is needed by the City as aroad right of way of the Molo Arevalo Boulevard.The trial court ruled in favour of Lanzar holding that the property in question had beenpossessed by the applicant and his predecessors-in-interest, publicly, continuously andadversely for more than 30 years and that the City failed to show proof that said land isnecessary for public utility or establishment of special industries.The Director of Lands and the City of Iloilo appealed to the CA which reversed the trialcourt’s decision, hence, this appeal.ISSUE:
