Unformatted text preview: Essay 1 – Patent vs. Trade secret Strategies To patent a device or idea, the first thing you need to do, to obtain the patent, is to make sure that there is not some previous invention using that technology. So in all situations, the patent search would actually come second, you first need to create the thing that you would patent. You need to have some device to actually be creating, and you also should not be reproducing something that was already in the public domain. Sales before the patent filing is permitted, however, they only allow you to be able to do sales for a limited time before the patent needs to be had. Otherwise you forfeit the patent right, and all profits that might have occurred from it. Overseas only really matters if they produce the same thing as you are selling and you are being undercut by the foreign market.
