Criminal Law How can you defend a guilty person? The purpose of the criminal law judicial system is not for the truth. . but to control the govt. 4, 5, 7, 8 amendments is to control the govt. other countries strive for the truth (inquisitorial system) to torture until the truth comes out. the american system was put in place to counteract this system. . not to protect criminals, but to protect the people from the govt. our system is the adversarial system. how can you defend the guilty? your job as a lawyer is to make sure the govt obeys the rules and that the trial is "right" and not corrupted. right to fair trial appointed lawyer if at or below poverty line search and seizure cops don't have probable cause and they stop and search you anyways without a warrant. . two laws violated. . should you still be charged? do we exclude the evidence and let you go. . and/or punish the cops as well to keep the govt in check probable cause is up to the judge. . fine line.
