Madison says they shouldn't. They were intended to be the least powerful branch. But, they do make laws because through their interpretations, they make laws. System Federal v. State Criminal v. Civil criminal is that the govt is one party and going against a defendant. there is almost always a fine and/or a punishment. very rarely is there anything going to the defense in a defensive win. the victim is just a witness, not a suer. in a civil case is a citizen v. citizen case typically. contract disputes, torts(accidental or quasi-intentional harms) for intentional torts, fine and punishment can be applied. the compensation in both is to make the victim whole Judges Judicial Review Marbury v.
