May 12, 1978ANTONIO, J.:Facts:Mariano Lim, deceased, with her mother, arrived at their residence andwas waiting for their housemaid to open the gate when Roque Dejungco andJose de los Santos, Juanito Ang and Romualdo Carreon, accused, kidnappedhim and killed him thereafter. The accused were paid by Victor Ng to kill thedeceased as Ruby Ng was in relationship with the latter and considered ashis rival for her affections and wanted to get rid of him. Ng and de losSantos, together with Dejungco, Carreon, Juanito Ang, Ty Sui Wong, John Doeand Peter Doe, were charged with Kidnapping with Murder and pleaded notguilty upon arraignment.CFI discharged accused Wong for failure of theprosecution to establish a prima facie case against him. The Court foundthem guilty of murder, qualified by reward.Upon appeal, Dejungco withdrewhis appeal before the records could be forwarded to the Supreme Court andCarreon abandoned his appeal while the same was pending before the trial
